Federal, state, and local governments may take private property through their power of eminent do-main or may regulate it by exercising their Police Power. The Fifth Amendment to the U.S. Constitution requires the
government to provide just compensation to the owner of the private property to be taken. A variety of property rights are subject to eminent domain,such as air, water, and land rights. The government takes private property through
condemnation proceedings. Throughout these proceedings, the property owner has the right of due process.

The Declining Human Race
For the first time in human history, people aged 65 and older will outnumber children under age 5, according to a report entitled "An Aging World: 2015". The report says, it's just around the corner, before 2020. By 2050, the proportion of the population 65 and older (15.6 percent) will be more than double that children under age 5 ( 7.2 percent).
The fertility rate (TFR) in many countries has fallen below the 2.1 children a couple needs to replace themselves, says the report. "Traditionally, children are the mainstay of old age support, especially when only one parent is still living," says this sidebar authored by researcher Martina Brandt at Dortmund University and Christian Deindl at University of Cologne. "However, people are not only living longer but also having fewer children, with rising childlessness among the older people. Thus new challenges arise: Who will provide help and care to the childless older people?" they write. "On what support networks can they rely? And, what role does state play in care provision?"

When Roosevelt spoke more than a century ago, American woman were producing 3.5 children each, well above the 2.1 needed to for population stability. He did not anticipate how strongly anti-child the U.S. would be after WWII:

Bio Mass Plant in Burney Gives Notice of Shut Down
Burney Forest Power biomass plant employees about 25 people, have given notice that it will cease operation toward the end of September. Their 30-year contract with Pacific Gas & Electric Co. ends in 2020 was amended last year, which gave Burney Forest Power more money for its electricity. The amendment expires Aug. 31, at which time the contract reverts back to the original terms. Osborne said he's been told by Burney Forest Power that it can't operate under the terms of the original contract because the rate PG&E will pay isn't enough to keep the doors open. Without the biomass plant, Shasta Green's operation might be in jeopardy and jobs of more than 100 employees. The company operates a logging and trucking arm in addition to their sawmill.

The California Marijuana Legalization Initiative , Prop. 64
November 8, 2016, Prop. 64 will be on the ballot in California as an initiated state statute to legalize "Adult Use of Marijuana Act".

Medical marijuana is already legal in California, which was the first state to legalize it in 1996. In 2010, Prop 19, a ballot item to legalize recreation marijuana, went before California voters in 2010 but failed to pass.
United States Drug Enforcement Administration (DEA)has marijuana listed as a Schedule 1 - drugs, substances, or chemicals are defined as drugs with no currently accepted medical use and a high potential for abuse. Some examples of Schedule I drugs are: heroin, lysergic acid diethylamide (LSD), marijuana (cannabis), 3,4-methylenedioxymethamphetamine (ecstasy), methaqualone, and peyote.

Brendan Dassey's Conviction Overturned
Brendan Dassey's murder case was widely publicized through Netflix’s hit series Making a Murderer exposing a corrupt legal system. August 12, 2016, a federal judge overturned Dassey's conviction.
Judge William E. Duffin found that Dassey’s confession in the murder of Teresa Halbach was involuntary under the Fifth and 14th Amendments, according to court documents. Dassey will be released in 90 days not unless the state chooses to retry the case.

Moon Valley Growers vs Lassen County Board of Supervisors
The Moon Valley Growers (Association) filed a lawsuit against Lassen County Board of Supervisors, July 11, 2016 for a Writ of Mandate to rescind, void and set aside portions of Lassen County 2016 medical marijuana ordinance. County Counsel Bob Burns drafted the liberal marijuana ordinance for the board members to approved on April 21, 2015. Later on, the County realized how much of a screw up the liberal ordinance was and that Burns had left loop holes in it, creating all sorts of chaos for the Lassen County residents and Sheriff Department, forcing the Lassen County Board of Supervisors to amend the marijuana ordinance , April 2016 to close the loop holes, changing that the pot growers must reside on the premises in a lawfully established structure, according to the Public Healthy and Safety code sec. 17922. This change in the ordinance lead to the Moon Valley Growers to sue the Board of Supervisors.
In Lassen County the word "reside" has a different definition for the ones running for office or holding an elected position,"Home is where the heart is at". Will the pot growers have that same privilege?
With other counties in California having more stricter marijuana ordinances, Lassen County's ordinances became a big welcome sign to the pot growers and cartels. It's estimated that there's over a 100 pot grows in Lassen County. The Board of Supervisors help create this problem and will not fund the Sheriff's department to help them to enforce the laws in Lassen County.
As of, August 12, 2016, the California Secretary of State does not have the Moon Valley Growers (Association) listed as being incorporated. In California, if an association is not incorporated, it cannot sue or be sued. You would think, the names of these individual pot growers would be listed as a party in the lawsuit, since the organization does not appear to be registered with the California Secretary of State.
Is this the reason Burns is retiring, because he got the county in a lot of hot water with his liberal marijuana ordinance? Did Burns or the Board of Supervisors profit from this liberal ordinance that they approved? If you recall, the Board of Supervisors were forewarned about hiring Burns as County Counsel, but Chapman had to have his "right -hand- man" in there by his side and the pack chose to follow after him. Now look, who will be left holding the bag after Bob Burns, Bob Pyle and Jim Chapman fly the coop, the taxpayers, as always.

County Clerk Bustamante has not given account for the huge drop in Absentee ballots in District 2. In 2012, nearly 65% voted by absentee ballot, but in 2016 only about 8% voted by absentee ballot. According to statisitics voting by absentee ballot increases, not decrease. Why the huge change for District? Fraud?

Greenleaf Power plant manager sends out letters notifying their suppliers that they will no longer accept fuel deliveries. PG&E's 25 - 30 contract expired, January 2016 may force many power plant closures in California, such as Greenleaf Power in Wendel, Ca.
June 9, 2016, The California Public Utilities Commission (CPUC) amended Pacific Gas and Electric Company (PG&E) renewable energy power purchase contract with Sierra Pacific Industries to allow for use of dead tree biomass resulting from drought and bark beetle infestation in response to Governor Brown's October 2015 Tree Mortality Emergency Proclamation. This agreement will allow 5 Sierra Pacific Industries biomass plants located in Anderson, Burney, Lincoln, Quincy, and Sonora to continue to operate.

Supervisor Chapman a Member of LCT Editorial Board?
In the LCT's Editorial and Opinions section, an article was written by an unknown author called, "Democracy really works when citizens get involved", or a more appropriate title would be,"Democracy really don't work when Government is in bed with local media..."?It was reported that Chapman recited the same article written in the local newspaper for an audience at the Lassen County Board meeting, word for word, leaving one to only assume, he is the author of the unclaimed article.
Recommendation: Change the wording in the article "Some service organization actually run the county from some secret, musty, dark closet hidden away ...", to "government is actually ran from a secret, musty, old smelly, dark basement hidden away.."
Note: Will Chapman be LCT's next "Managing Editor" in 2017?

Coming Soon New Pool Sign
John and Eileen Spencer made a generous contribution to cover the cost of the new pool sign for the Honey Lake Valley Community Pool that's under construction. The Spencers will be meeting with Jared Hancock, the authority's executive officer to discuss the sign designs and cost.
For some unknown reason, this generous contribution was not reported in the local newspaper.
Would this be considered selective news reporting or bias news reporting?
Note: The new pool will not be called the "Jim Chapman Pool".

Prop. 57 claims; Net state savings that could range from the tens of millions of dollars to the low hundreds of millions of dollars annually primarily due to a reduction in the prison population from additional paroles granted and credits earned. Net county costs that could range from the millions to tens of millions of dollars annually, declining to a few million dollars after initial implementation of the measure.
Sc00p's Recommendation; trim government salaries, benefits and retirement, rather than compromise our safety. Place private sector over prisons to stop government waste.
Dr. Lawrence J McQuillan stated, about 51% of the people working in the private sector make less and do not have a pension plan, as the public sector do. His video is well worth watching to show how government is a self-dealing, greedy, immoral entity. If government were held to the private sector's accounting standards, their accounting practices would be considered criminal.

Will Bob Burns go for Judge Mallery's seat in 2018?
Mallery beat Burns in the 2012 General Election for judge, after Burns was a head of him in the 2012 Primary Election. There seems to be a lot of complaints floating around that Judge Mallery is not supportive enough of law enforcement and soft on crime in Lassen County. Mallery has two rating on the The Robing Room, the place where judges get judged by the people, besides casting their votes at an election. One person rates him a 10 and leaves comment, "Judge Mallery has integrity. The best thing that's happened to Lasen County in a long time." Another person with a totally opposite opinion leaves him with a zero rating and a comment, "This judge makes political decisions on the bench."
